These Terms of Service (“Terms”) govern your access to and use of the website at getbanked.co and the services provided by GetBanked Ltd. By submitting a pre-approval form, using our website, or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Who We Are

GetBanked Ltd (“GetBanked”, “we”, “us”, “our”) is an independent banking infrastructure advisor. We provide introductory and advisory services to businesses seeking access to banking and electronic money institution (EMI) services.

We are not a bank, EMI, payment institution, credit institution, or regulated financial services provider — and we are not required to be. We do not hold, handle, move, or transmit client funds at any point. We do not provide financial advice, credit facilities, or investment services. Our role is strictly limited to:

  • Assessing whether a client's business is likely to be accepted by banking or EMI partners in our network
  • Introducing clients to regulated banking and EMI institutions where we believe there is a match
  • Assisting clients in understanding and preparing documentation that they submit directly to those institutions

All banking, payment, and financial services are provided solely by the regulated third-party institutions to which clients are introduced.

2. Our Services

GetBanked provides the following services:

  • Pre-approval assessment: A free, no-obligation evaluation of your business's likelihood of acceptance by banking partners in our network
  • Bank and EMI matching: Identifying suitable regulated institutions from our network based on your business profile
  • Introduction services: Formal introduction of your business to a specific banking or EMI institution
  • Documentation guidance: Advisory assistance with understanding KYB/KYC documentation requirements; clients submit all documents directly to institutions themselves
  • Concierge services (where agreed): Full document preparation assistance, dedicated account management, and escalation support

All services are subject to eligibility. We reserve the right to decline to provide introductions or services to any business at our sole discretion, without obligation to provide reasons.

3. Pre-Approval

Our pre-approval assessment is provided free of charge and carries no obligation on either party. Submitting a pre-approval form does not constitute a contract or guarantee of any outcome.

We will respond to pre-approval submissions within 24 hours with an honest assessment based on the information provided. This assessment is our professional opinion and does not constitute a guarantee that a banking application will be accepted.

Pre-approval responses are confidential and provided solely for the use of the submitting business. They may not be shared, published, or represented as a banking guarantee.

4. Fees and Payment

We operate on a success-aligned fee model:

  • No upfront fees of any kind. We do not charge retainers, assessment fees, or any other fee before we have confirmed that a specific bank or EMI can onboard your business.
  • A fee becomes payable only when: (a) we have identified a specific institution that has confirmed it can onboard your business, and (b) you have chosen to proceed with that introduction.
  • The specific fee amount will always be agreed in writing before you are required to pay anything.
  • Fees are non-refundable once a bank account or EMI account is operational.

Additional fees may apply for Concierge-tier services including full document preparation, regulatory mapping, and dedicated account management. These will be agreed separately in writing before any work commences.

If we are unable to identify a bank or EMI that can onboard your business, we will inform you honestly and no fee will be charged.

5. Client Obligations

By using our services, you agree to:

  • Provide accurate, complete, and up-to-date information at all times
  • Notify us promptly of any material changes to your business, ownership structure, licensing status, or operating model
  • Not use our services in connection with any unlawful activity or for any purpose that violates applicable laws or regulations
  • Cooperate fully with the KYB/KYC requirements of the banking or EMI institutions to which you are introduced
  • Not use our services to introduce your business to institutions for the purpose of circumventing regulatory requirements

Providing false, misleading, or materially incomplete information will result in immediate termination of services. No fee refund will be made in such circumstances, and we reserve the right to report the matter to relevant authorities if required by law.

6. Confidentiality

Both parties agree to keep confidential all non-public information shared in the course of our engagement, including business data, pricing, and the identity of banking partners we approach on your behalf.

We will not share your business information with any banking or EMI partner without your explicit prior consent. You will be informed of the specific institution before any introduction is made.

This obligation survives termination of our engagement for a period of two (2) years.

7. No Guarantee of Outcome

GetBanked does not guarantee, represent, or warrant that:

  • Any banking or EMI application will be approved
  • Any particular institution will accept or maintain your account
  • The services of any institution we introduce you to will meet your specific requirements

Banking and account decisions rest entirely with the relevant regulated institution. Such institutions may decline applications, impose conditions, or close accounts at their discretion. GetBanked is not liable for such decisions.

8. Intellectual Property

All content on this website, including text, graphics, design, and code, is owned by or licensed to GetBanked Ltd and is protected by UK and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this site without our prior written consent.

Nothing in these Terms transfers any intellectual property rights to you.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • GetBanked's total liability to you in connection with any service shall not exceed the fees actually paid by you to GetBanked for that specific service
  • We are not liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits, loss of data, loss of business, or reputational damage, whether arising in contract, tort (including negligence), or otherwise
  • We are not liable for the acts, omissions, decisions, or conduct of any banking or EMI institution to which we introduce you
  • We are not liable for any delays, failures, or losses resulting from factors outside our reasonable control

Nothing in these Terms limits or excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

10. Termination

Either party may terminate an engagement by providing written notice to the other. Termination does not affect any fees already due or any obligations that survive termination.

We may terminate or suspend access to our services immediately and without notice if you breach these Terms, provide false information, or use our services for unlawful purposes.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before commencing legal proceedings, both parties agree to attempt resolution in good faith through direct negotiation for a period of not less than 30 days.

12. Entire Agreement

These Terms, together with our Privacy Policy and any written fee agreement, constitute the entire agreement between you and GetBanked Ltd relating to your use of our services, and supersede all prior agreements, understandings, or representations.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated via email or a notice on our website. The “last updated” date at the top of this page reflects the current version.

Continued use of our services after updated Terms are posted constitutes your acceptance of the changes.
